Is there something better?" days, months, years after choosing that ONE thing. It creates up a real sense of commitment Phobia. Give me two options and I’m confident I’ll make the right choice. But with more options, I'm frozen. paralyzed. decision constipation. So… Just as a reminder.In order to find clarity to make the RIGHT choice, sometimes you've gotta strip back the noise, cut the fat and clean house!  Meaning, paying attention to what really matters, letting go of unnecessary, frivolous crap that you don't really care about, and continuously reminding yourself that more is NOT the solution. Clear the clutter and make way for more peace. Oh.And… Simplicity seems… simple. See you on the other side.#rantover

General.

The Tyler Ward Hoopty Week Promotion (“Promotion”) is being offered by Tyler Ward Music, LLC (“Sponsor”), whose address appears at the bottom of these Official Rules.  The Promotion begins on June 14, 2014 at 12:00 am Pacific Standard Time (“PST”) and will end on June 19 at 11:59 AM PST (“Closing Date”).

By entering the Promotion, participants accept and agree to be bound by these Official Rules.

Odds of Winning.  The odds of being the selected participant are dependent upon the number of eligible submissions received.  The Sponsor estimates approximately 10,000 entries, in which case the odds would be 10,000 to 1.

Eligibility.

The Promotion is open to legal residents of the United States and Canada (excluding Quebec) who are at least eighteen (18) years of age or older at the time of entry, depending upon whether or not they are eligible according to the governing laws of their jurisdictional residence.  Proof of age and identity will be required.  To be eligible, participants and travel companions must be able to travel legally to, from and within the United States (e.g., have proper photo identification, passport, travel documents, etc.).

The selected participant (or the selected participant’s companion) must meet any additional requirements of the airline and/or hotel (e.g., age restrictions, credit card for reservations if required, passport or other identification, etc.) and no guarantee is made by the Sponsor that eligibility for entry in the Promotion ensures that the participant will meet the eligibility requirements of the hotel and/or airline.

The Promotion is void where and to the extent prohibited by law and is subject to all applicable laws, including, without limitation, federal, state, and local laws and regulations.  Employees and affiliates of the Sponsor, Ground Ctrl, The Firm and/or members of such affiliates’ immediate families or households are ineligible to participate in the Promotion.

How to Enter.

No purchase is necessary to enter the Promotion. This Promotion is not intended to be an inducement to purchase any good, service or other product and does not require its participants to incur any monetary obligation, visit any business or attend or listen to any sales presentation. The Promotion will be announced on official Tyler Ward social media sites (e.g., YouTube, Facebook, Twitter, etc.) and possibly through email blasts. All fans who comment on, like, tweet and post the the Official Music Video for Hoopty Hoop video on thier pesonal facebook pages video , located at youtube.com/tylerwardmusic (“Official Video”) may be entered in the Promotion by sending an e-mail to  HYPERLINK “mailto:contest@tylerwardmusic.com” contest@tylerwardmusic.com with a screenshot that shows their comment, like, tweet and facebook post together with their full name, date of birth, and current physical address.  Others may enter the Promotion by mailing a 3” x 5” postcard containing the exact promotion name, “Tyler Ward Hoopty Week Promotion,” the participant’s name, home address, telephone number, e-mail address and date of birth to Keller Turner Ruth Andrews Ghanem & Heller, PLLC, 700 12th Avenue South, Suite 302, Nashville, TN 37203.

Entries by all methods are collectively referred to as “Submissions.”  The Promotion Sponsor is not responsible for Submissions that are incomplete, illegible, inaudible, damaged, irregular, have been submitted through illicit means, or do not conform to or satisfy any technical specification and/or condition of these Official Rules and all such entries shall be disqualified.

Entry Disputes.  In the event of a dispute, Submissions made by Internet will be declared made by the Authorized Account Holder of the e-mail address submitted at time of entry. “Authorized Account Holder” is defined as the natural person who is assigned to the social media account and/or e-mail address by an Internet service provider, online service provider or other organization (e.g. business, educational institution, etc.) that is responsible for assigning social media accounts and/or e-mail addresses related to the particular Submission.

Submission Deadline.  All Submissions must be received by the Closing Date and time.  All Submissions become the exclusive property of the Sponsor, and none will be acknowledged or returned.  Proof of sending or submission will not be deemed to be proof of receipt by the Sponsor.

Submission Selection and Notification.

On or about June 19, 2014, in Los Angeles, California at 11:00 am PST, a random draw will be conducted from all eligible entries received from all eligible entry methods by the Closing Date in order to select one (1) potential winner (“Selected Participant”).  The decisions of the Sponsor shall be final and binding in all matters relating to the Promotion.

The Selected Participant will be notified by email or telephone within three (3) business days of the drawing.  Individuals need not be present at the drawing in order to be selected.  If the first Selected Participant cannot be reached within three (3) days of the first contact attempt by the independent judging organization, or if the first Selected Participant does not accept the Prize, or is found to be ineligible or does not otherwise meet the requirements as set out in these Official Rules, the Sponsor shall have the right to disqualify that participant and to randomly draw another eligible entry.  By entering, you agree that if you are a Selected Participant that is disqualified and the Prize is forfeited for any reason, the Sponsor shall be fully and completely released and discharged from any liability or responsibility in this regard. The Sponsor is not responsible for the failure for any reason whatsoever of a Selected Participant to receive notification.

If a Selected Participant is a Canadian resident, upon notification, the Selected Participant, must, unaided, correctly answer a time-limited mathematical skill-testing question.  In the event that a Selected Participant is unable to answer the skill-testing question correctly, the Sponsor shall have the right to disqualify said participant and to randomly draw another eligible entry, and the Sponsor shall be fully and completely released and discharged from any liability or responsibility in this regard.

The name of the Selected Participant will be posted on the official Tyler Ward web site once the Selected Participant has been confirmed by the Sponsor.

Prize.  

There will be one (1) prize (“Prize”) offered in connection with the Promotion, which will include the following:

Round-trip economy air travel for two (2) individuals to Nashville, Tennessee from the closest international airport to the Selected Participant’s residence within the continental United States or Canada from which the designated airline flies to Nashville, Tennessee.  The Selected Participant and his/her travel companion must have the same origin and destination and must travel together at all times.  Blackout travel dates might apply.  Travel must coincide with the Tyler Ward concert in Nashville, Tennessee scheduled for June 24, 2014 (“Concert”).

One (1) night standard accommodations (one room, double occupancy) at a selected hotel in Nashville, TN.  Accommodations are subject to availability at the time of booking and must coincide with the Concert.

Meet and greet with Tyler Ward at the Concert.

The approximate retail value of the Prize is One Thousand Five Hundred U.S. Dollars ($1,500 USD), which may vary based on Selected Participant’s origin of travel and rates available at time of booking.

The Selected Participant and his/her travel companion will be solely responsible for all air travel outside of the continental U.S. and Canada, all ground transportation (including to and from the airport, hotel and venue), meals, and other entertainment, souvenirs, local and long distance telephone calls, gratuities, applicable taxes, incidentals, and all other costs and expenses not specifically mentioned as included above.  Any damage or other costs incurred in connection with the hotel room rental other than the basic room rental fee shall be the sole responsibility of the Selected Participant.  The Selected Participant and his/her travel companion will be solely responsible for obtaining any required travel identification and documents and any health or other insurance coverage required or desired in connection with or incidental to any of the activities identified above.  Cancellation insurance is not part of the Prize, but is recommended.  No alternative value will be included for any activity or opportunity available and not accepted by the Selected Participant or his/her travel companion.

Only the Selected Participant will be permitted to attend the Concert and may bring one (1) guest of their choosing.  YOU UNDERSTAND THAT THE TICKETS IN THIS PROMOTION ARE PERSONAL AND NONTRANSFERRABLE.  Show times and locations are subject to change and/or cancellation without notice or liability to the Selected Participant.

Prize Redemption.

The Concert is scheduled for June 24, 2014 and the Prize may only be redeemed at that time.  Any unused portion of the Prize value is forfeited.

Sponsor holds no responsibility for weather conditions or any other factors that might interfere with redemption of the Prize or otherwise impact the Selected Participant’s use and enjoyment thereof.  Notwithstanding the forgoing, Sponsor shall use reasonable efforts to assist the Selected Participant in rescheduling flights and/or hotel to the extent the same is necessitated by a cancellation or postponement of the Concert due solely to the acts or omissions of Sponsor within its control, provided that doing so does not cause Sponsor to incur additional costs or expenses and, provided further that Sponsor’s failure or inability to do so shall not result in any liability of Sponsor or its officers, directors, agents or assigns.  In the event that the Concert is cancelled and/or postponed, and the Selected Participant has already booked a flight and/or hotel, then he/she may keep those reservations and, if the Concert is rescheduled, the Selected Participant may redeem the VIP tickets, and meet-and-greet pass at the rescheduled event, provided he/she shall be solely responsible for all travel (including hotel and airfare) in connection therewith.  It is the Selected Participant’s responsibility to indicate to Sponsor how he/she prefers to address the forgoing contingency, which in all respects shall be subject to Sponsor’s approval, and the Selected Participant’s failure to do so may result in forfeiture.

By accepting the Prize, the Selected Participant and his/her travel companion accept the inherently dangerous nature and risk involved in connection therewith, including personal injury and/or death, acknowledges that his/her participation in the Prize activities is voluntary, acknowledges that there are natural factors and occurrences which may impact or affect the safety of the activities he/she is participating in and he/she assumes the risk of such factors and occurrences and agrees that Sponsor and its officers, directors, agents and assigns shall not in any way be responsible for any resulting injury or death, or any other personal or property damage.

Rights in Certain Materials.  Except where legally prohibited, your Submission constitutes permission for Sponsor or its affiliates and licensees to use each Submission, including your name, voice, image, likeness and address (city and state), in printed, broadcast or any other media as set out above, in perpetuity, in any manner it deems appropriate, including, without limitation, in record artwork, marketing, promotions and merchandising efforts, or in any other way the Sponsor or its representatives see fit in their sole discretion, or may refrain from doing any of the foregoing, without further compensation or notice to the party who makes the Submission.  Additionally, the Selected Participant hereby irrevocably grants, transfers, sells, assigns and conveys to Tyler Ward Music, LLC, its successors and assigns, all present and future right, title and interest of every kind and nature whatsoever, including, without limitation, all copyrights (and any renewals and extensions thereof) and all rights incidental, subsidiary, ancillary or allied thereto (including, without limitation, all derivative rights) in and to any and all still images and audio and/or audio-visual recordings captured while in Nashville for the Concert (“Recorded Materials”), for exploitation (whether for promotional, commercial or for other purposes) throughout the universe, in perpetuity, by means of any and all media and devices whether now known or hereafter devised (the “Rights”).  Without limiting the forgoing, the Selected Participant specifically acknowledges and agrees that the right to create or cause the creation of any Recorded Materials inside the venue is not included in the Prize and that the Selected Participant’s right to make such recordings shall be expressly conditioned upon the grant of Rights herein described.

Release.

By entering the Promotion, participants agree to release and hold harmless Sponsor and those involved in the development, production, implementation and distribution of the Promotion and their respective parent companies, affiliates, subsidiaries, service providers, and agencies, and their directors, officers, agents, employees, attorneys, and any other person or entity associated with such entities and/or promotion (hereinafter collectively called “Promoters”) from and against any claims, damages, losses or injuries of any kind to person or property, including but not limited to death, including any third party claims, arising from or relating to, in whole or in part, the Promotion, including submission and participation in the Promotion, and acceptance, possession, use or misuse of the awarded Prize, any portion of the Prize or related activity, including any travel.  Promoters shall not be liable for submissions that are delayed, lost, misdirected, misdelivered, marked postage-due, illegible, mutilated, incorrect or incomplete, and such submissions will not be eligible for the Promotion.  Promoters shall not be responsible for any technical malfunctions of any telephone network, computer on-line system, computer equipment or software; program malfunctions or other failures; delayed computer transactions or network connections; any errors of any kind, whether human, mechanical or electronic; or any combination thereof, including, without limitation, any injury or damage to the computer of any participant or any other person related to or resulting from downloading any part of the Promotion.  This release is given with the knowledge that Sponsor will rely upon it at substantial cost to it and you agree not to assert or maintain against Sponsor or its affiliates, licensees and assigns, any claim, action, suit or demand of any kind or nature whatsoever, including but not limited to, those grounded upon invasion of the right of privacy or of publicity or any other civil rights, defamation, libel or slander or for any reason in connection with the exercise of the consent of rights granted by you herein.  You acknowledge that Sponsor may assign these rights granted by you in, in whole or in part, to any person or entity.  Any person attempting to defraud or in any way tamper with the Promotion will be ineligible and may be prosecuted to the full extent of the law. Sponsor reserves the right, in its sole discretion, to cancel or suspend the Promotion should viruses, bugs or other causes beyond its control corrupt the proper administration or security of a Promotion.  Sponsor reserves the right to modify the Official Rules of the Promotion in any way or at any time, as long as reasonable notice is given via this website.

Except where prohibited, by entering the Promotion, the Selected Participant agrees to execute and return to the independent judging organization within ten (10) business days of notification of selection: (i) An affidavit affirming eligibility and compliance with all Official Rules, together with proof of age in a form acceptable to Sponsor; (ii) A liability release form; and (iii) A publicity release form, which shall include provisions relating to use and ownership of Recorded Materials.  The Selected Participant’s travel companion must sign and return a liability and publicity release form within the time limits set forth above in order to participate.

If the selected participant or his/her travel companion fails to submit the above within the given time period, the Sponsor reserves the right to disqualify said participant and randomly draw another eligible entry for the purpose of awarding the Prize (time permitting), and the Sweepstakes Sponsor shall be fully and completely released and discharged from any liability or responsibility in this regard.

Governing Law.  The Promotion shall be governed by the laws of the State of Tennessee, United States of America. By participating in this Promotion, participants agree that the state and federal courts located in the State of Tennessee, County of Davidson shall have jurisdiction over any dispute or litigation arising from or relating to this Promotion and that venue for such litigation shall be only in the Chancery Court for the City of Nashville, Tennessee, or the United States District Court for the Middle District of Tennessee, or, at the election of Tyler Ward Music, LLC, any dispute or claim of any kind will be resolved by binding arbitration, such arbitration to be held in Nashville, Tennessee, and shall be held in accordance with the rules of the American Arbitration Association.
